Welcome to LabAIsistant, an AI-powered platform that helps users understand their lab reports in plain language. These Terms of Service (“Terms”) govern your access to and use of the LabAIsistant website, application, and related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Definitions

• User means any person who accesses or uses the Service.
• Service refers to the LabAIsistant website, app, and related tools and features.
• Lab Report refers to any diagnostic test report uploaded by the user.
• AI Summary refers to the automated summary, observations, recommendations, and other content generated by the Service.

1. Eligibility

You must be at least 18 years old to use this Service. If you are submitting a report on behalf of a minor, you confirm that you are authorized to do so.

2. Service Description

LabAIsistant provides AI-generated insights to help users understand their lab reports. The Service includes:

• Automated observations based on the values present in the uploaded lab report.
• General non-clinical recommendations related to lifestyle, diet, hydration, stress, etc.
• Support for multiple Indian languages for easier interpretation.
• Optional audio narration of the AI-generated summary, available in supported Indian languages and voices for accessibility.

We strive to make the Service accessible to users with diverse needs, including providing audio summaries for visually impaired users. However, we do not guarantee compatibility with all assistive technologies or accessibility standards.

The observations may mention potential implications or commonly associated conditions based on whether a value is above or below standard reference ranges. These references are based on widely available medical literature, and:

• Are not intended to provide a medical diagnosis, treatment plan, or clinical decision.
• Should only be used for educational purposes to prompt informed discussions with a licensed healthcare provider.
• Are generated by AI and not reviewed on a case-by-case basis by a medical professional.

Due to the evolving nature of AI technology, generated summaries may occasionally contain inaccuracies or lack context. Users are advised to treat the content as informational and to confirm any findings with a licensed medical professional.

These outputs—including any audio narration—are generated by AI models and reviewed during development by medical professionals for content quality. However:

• They are not intended to be medical advice, diagnosis, or a substitute for professional consultation.
• Users should not rely on the outputs to make healthcare decisions without consulting a qualified doctor.
• The goal is to help users better understand their reports and encourage appropriate medical follow-up.

No Medical Relationship

LabAIsistant does not provide medical care, and your use of the Service does not create a doctor-patient relationship. All information generated is intended for general understanding and educational use only. Always seek advice from a qualified healthcare provider before making medical decisions based on the content provided.

Do Not Use in Emergencies

The Service is not designed or intended for use in medical emergencies or for urgent health situations. If you believe you or someone else may be experiencing a medical emergency, call your doctor or emergency services immediately.

Accessibility Commitment

LabAIsistant strives to make the platform accessible to all users, including those with visual impairments. If you experience any accessibility barriers, please contact us at support@labaisistant.com so we can provide assistance and continuously improve the platform’s accessibility.

Fair Use of AI Content

You agree not to reproduce, republish, or commercially exploit the AI-generated summaries or insights without explicit written permission from LabAIsistant. The content is intended solely for your personal informational use.

2A. Beta Features

LabAIsistant may occasionally introduce new tools or features labeled as “beta” or “experimental.” These features are provided on an “as-is” basis, may be modified or removed at any time, and may not function as intended. We disclaim all liability related to your use of such beta features.

AI Output Disclaimer

The Service may use third-party AI models to generate summaries and recommendations. While we strive to ensure quality, we do not control the full behavior of these models and disclaim liability for any inaccurate or unexpected outputs.

3. Free Access Period

LabAIsistant is currently offered under a free access period. During this time, no payments are required to use the Service. Future subscription plans or paid features may be introduced, and users will be notified in advance.

4. User Data and Privacy

4.1 Lab Reports

• No Storage or Access: Uploaded lab reports are processed by AI and are not stored or accessible after processing.
• Uploaded reports may be temporarily stored for up to 15 minutes during processing and delivery, after which they are automatically and permanently deleted from our systems.
• No Human Review: The content of lab reports is never viewed by any person, including developers or mentors.
• You retain ownership of the content you upload. By submitting a lab report, you grant LabAIsistant a temporary, limited license to process the data solely for the purpose of generating the AI Summary. This license terminates once the report is deleted from our system.

4.2 Personal Information

We collect only your name, email address, or phone number, which you provide voluntarily. This data is:

• Used solely for sending reports, audit logs, and limited marketing communications.
• You may opt out of receiving marketing communications at any time by contacting us directly at support@labaisistant.com.
• Stored securely and never sold or shared with third parties, except as required by law or legal process, or with trusted service providers acting on our behalf under strict confidentiality obligations. It is not permanently linked to the uploaded report or health data.

4.3 International Data Processing

Lab report data may be processed on secure cloud servers located outside India. By using the Service, you consent to this processing solely for the purpose of generating your report.

4.4 Children’s Data

If you submit a report on behalf of a minor, you confirm that you are legally authorized to do so. We do not knowingly collect or store personal information from children without appropriate parental or guardian consent. Reports submitted for minors are processed in the same secure, non-stored manner described above.

4.5 Data Security

We implement appropriate technical and organizational safeguards—including encryption, secure access controls, and audit logging—to protect personal data and ensure data confidentiality during processing. While we strive to ensure security, no method of transmission or storage is 100% secure.

4.6 Cookies and Analytics

We may use cookies and third-party analytics tools to understand usage patterns and improve the Service. These tools may collect anonymized information such as device type, session duration, and interaction patterns. By using the Service, you consent to this limited data collection. You can manage cookies through your browser settings.

5. User Responsibilities

By using the Service, you agree to:

• Submit only reports that you are authorized to use.
• Use the built-in redaction tool to manually blur out any personally identifiable information (PII) such as names, patient IDs, hospital logos, barcodes, and QR codes. You may retain Age and Gender, as they help in generating more personalized and relevant insights.
• Avoid uploading documents containing sensitive or unrelated personal information.

You agree not to:

• Use the Service for any unlawful, harmful, or fraudulent activity.
• Attempt to access, modify, or interfere with any part of the system without authorization.
• Use automated systems (e.g., bots or scrapers) to extract data from the platform.
• Upload reports that contain intentionally misleading, offensive, or inappropriate content.

6. Internal Mentorship and Content Review

LabAIsistant may engage licensed medical professionals (“Mentors”) to review the structure, tone, and general content quality of AI-generated summaries during development. Mentors do not access any real user data or uploaded lab reports, nor do they provide individual consultations or clinical guidance.

7. Intellectual Property

All content, software, branding, and materials related to the Service are the exclusive property of LabAIsistant or its licensors. You may not reproduce, modify, distribute, or reverse-engineer any part of the Service without express written permission.

8. Limitation of Liability

The Service is provided “as is” without warranties of any kind. LabAIsistant is not liable for any outcomes or decisions made based on AI-generated content. Our total liability, under any circumstance, is limited to the amount paid by you (if any).

Force Majeure: LabAIsistant shall not be liable for delays or failures due to events beyond our control.

9. Termination

We reserve the right to suspend or terminate your access if you violate these Terms. You may discontinue use at any time.

10. Third-Party Services

We may use third-party services to operate and improve the Service. These providers are bound by confidentiality obligations and will not use data for marketing purposes.

11. Governing Law

These Terms are governed by the laws of India. Disputes will be subject to the exclusive jurisdiction of the courts in Varanasi, India. Use from outside India is at your own risk.

12A. Dispute Resolution

Disputes will be resolved through binding arbitration under the Arbitration and Conciliation Act, 1996, in Varanasi, India.

13. Changes to These Terms

We may update these Terms at any time, with changes effective upon posting. Continued use constitutes acceptance.

14. Indemnification

You agree to indemnify LabAIsistant against claims arising from your use of the Service or violation of these Terms.

15. Severability

If any provision of these Terms is found to be unlawful, void, or for any reason unenforceable, that provision will be considered severable from these Terms and will not affect the validity and enforceability of the remaining provisions.

15A. Survivability

Any provisions of these Terms that by their nature should survive termination—including but not limited to Intellectual Property, Indemnification, Limitation of Liability, and Governing Law—shall remain in effect even after your use of the Service ends.

16. Entire Agreement

These Terms constitute the entire agreement between you and LabAIsistant regarding your use of the Service and supersede any prior agreements or understandings, whether oral or written.

17. Copyright and Infringement Claims

If you believe that any content uploaded or generated through the Service violates your intellectual property rights, please contact us at support@labaisistant.com with detailed information. We will promptly investigate and take appropriate action under applicable law.

18. Governing Language

In the event of any inconsistency between translated versions of these Terms and the English version, the English version shall prevail and be the binding version.
